Dispute Resolution

At BOM, we advise leading private and public sector entities on the full spectrum of corporate legal affairs—integrating legal precision with commercial clarity to support strategic decision-making at every level of the business.

BOM’s dispute resolution practice combines deep procedural knowledge with strategic litigation management across Saudi Arabia’s reformed commercial justice system. Our team represents clients before the Commercial Courts, Courts of Appeal, and the Supreme Court in disputes arising from contracts, corporate matters, real estate, and financial instruments. We also act as arbitrators and counsel in domestic and international arbitral proceedings, including cases administered by the Saudi Center for Commercial Arbitration (SCCA), the ICC, LCIA, and SIAC.

Saudi Arabia’s dispute resolution landscape has been fundamentally reshaped by the Commercial Courts Law (Royal Decree M/93 of 1441H), the Civil Procedure Law, and the Enforcement Law — reforms that have significantly improved the speed, predictability, and enforceability of commercial judgments. The SCCA has emerged as the Kingdom’s primary institutional arbitration forum, offering a modern framework aligned with the UNCITRAL Model Law and accredited under the International Chamber of Commerce.

We are trusted by clients for our ability to assess risk, manage complexity, and deliver outcomes in high-stakes proceedings. Our track record includes a landmark ruling cancelling a USD 58 million marketing agreement on grounds of material breach and misrepresentation, and a judgment restoring title to a SAR 200 million real estate asset against forged documentation — outcomes that reflect the depth of our litigation strategy and our command of Saudi procedural and substantive law.

Beyond litigation and arbitration, we advise on enforcement of domestic and foreign judgments and arbitral awards — including cross-border enforcement under the Riyadh Arab Agreement and the New York Convention on Recognition and Enforcement of Foreign Arbitral Awards. We also handle urgent applications for attachment orders, travel bans, and provisional measures, and represent clients in regulatory proceedings and penalty appeals before the CMA, SAMA, ZATCA, and other authorities.
